Compliance Testing

Compliance

Annual reviews required by the IRS and Department of Labor to ensure a retirement plan does not unfairly favor highly compensated employees (HCEs) over non-highly compensated employees (NHCEs). Common tests include the ADP test for deferrals and the ACP test for matching contributions. Solo 401(k) plans with only owners and spouses are generally exempt from these tests.
