Any employee who does not meet the IRS definition of a Highly Compensated Employee (HCE). This includes employees who own 5% or less of the business and earn below the HCE compensation threshold. NHCEs are the comparison group in nondiscrimination testing to ensure 401(k) plans benefit all employees fairly.
